Digital Wallet Terms

A mobile wallet is a method by which you can access your credit card on an eligible mobile phone, tablet, computer, watch or other device to make payments to or other transactions with merchants including digital merchants that accept presentment of credit cards by way of a mobile wallet (“Wallet”). These Mission Lane Digital Wallet Terms and Conditions (“Wallet Terms”) govern use of your MIssion Lane Visa® Credit Card (“Credit Card”) when you attempt to add or add your Credit Card to your Wallet. When you add your Credit Card to the Wallet, you agree to these Wallet Terms. Defined terms used herein shall have the meaning set forth in your Card Agreement (defined below).

The Mission Lane Visa® Cardholder Agreement along with any other agreements or disclosures we provide to you (collectively, the Card Agreement) still govern use of your Credit Card through the Wallet. This includes any applicable fees, interest rates or interest charges identified in your Card Agreement.

Mission Lane respects your privacy and is committed to protecting your personally identifiable information. Our Privacy Policy (available at: https://www.missionlane.com/legal) describes how we collect and use your information. In order for you to use your Credit Card through your Wallet, we need to share information with third parties that include but are not limited to your Wallet provider, your mobile carrier and merchants. You consent to us sharing your information with such third parties when you request to access your Credit Card through your Wallet, when you initiate a Credit Card transaction through your Wallet and in order to facilitate other Wallet transactions that you may request.

You understand that Credit Card transactions that may appear in your Wallet are not intended to be an accurate or complete record of your Credit Card transaction history. Please refer to the monthly periodic statement provided to you by Mission Lane to view a complete record of your Credit Card transaction history.

When you add your Credit Card to your Wallet, you consent to us sending you messages and other communications through the Wallet. You can disable these messages sent to you in your Wallet by changing your mobile device settings.

To use your Wallet you may be subject to additional terms and fees by third parties such as the Wallet provider or your mobile carrier. Any third party terms you agree to in order to use your Wallet do not amend or supersede any agreements you have with us including but not limited to your Wallet Terms and your Card Agreement. You acknowledge and agree that Mission Lane is not a party to any third party terms you may have with your Wallet provider, mobile carrier or other similar third party. Please carefully review those third party terms to understand how they may impact you, your use of the Wallet and any fees you may be responsible for paying.

Mission Lane is not responsible for any failed or delayed messages by your mobile carrier, the Wallet nor will Mission Lane be responsible in any way for any losses or damages that you may incur as a result of the Wallet not functioning properly including any errors, delays or the inability to use the Wallet to make a payment or other transaction. Mission Lane also reserves the right to discontinue offering support or to cancel or terminate your ability to use your Credit Card with the Wallet at any time. Mission Lane may also amend these Wallet Terms at any time and if required by applicable law, we will notify you of the changes.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MISSION LANE OR ANY OF ITS EMPLOYEES, EXECUTIVES, CONTRACTORS, AGENTS, PARENT COMPANIES, AFFILIATES, OR BUSINESS PARTNERS (“MISSION LANE PARTIES”) BE LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT OR INDIRECT, EXEMPLARY, LIQUIDATED, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES ARISING IN CONNECTION WITH YOUR INABILITY TO USE YOUR WALLET INCLUDING ACCESSING YOUR CARD THROUGH THE WALLET, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE, EVEN IF A MISSION LANE PARTY, IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES.
